1] Heard both sides. The present applicant who is arrested in Crime No. 41 of 2012 registered at Police Station, Jalkot, Dist. Latur, for the offences punishable under Sections 307, 498-A, 323, 504, 506 r/w. 34 of IPC, is praying for his release on bail.

2] The allegations are that, over unlawful demand of money, the present applicant, alongwith his parents has beaten his wife. The marriage took place on 6th May, 2011. Ultimately,on the date of the incident, initially the present applicant alongwith his parents whipped his wife, and thereafter at the instance of his parents, the present applicant, forcibly administered poison to her. In the circumstances, the offence came to be registered.

3] Learned counsel for the applicant submits that now the investigation is complete. Father of the applicant, who was one of the co-accused has committed suicide while he was in judicial custody. The mother of the applicant is already released

on bail. As charge sheet is filed, material on record would not show that any poison was detected. In the circumstances, he submits that the application may be allowed.

4] Learned APP vehemently opposed the application.

¶20

5] Considering the fact that the trial may take its own time, in my view, by imposing stringent conditions, the applicant may be released on bail.

¶21

6] The applicant be released on executing P.R. bond in the sum of Rs. 20,000/- and also on furnishing surety in the like amount.

[ii] The applicant shall not enter the territorial jurisdiction of Jalkot Tahsil, for a period of 2 years from the date of his release or till the trial concludes, whichever is earlier, without previous permission of the concerned court.
