Heard the learned A.P.P for the Respondent – State. Perused the report produced by the Crime Branch, Bhiwandi Unit. It appears that the Applicant who is under-trial prisoner is facing the trial for the offences punishable under Section 395 of the Indian Penal Code and Sections 3 and 25 of the Arms Act. Eleven witnesses are already examined and five are yet to be examined. Moreover, it is further disclosed in the report that the present Applicant-Accused is involved in three other matters, two for the offence punishable under Section 395 and one under Section 397 of the Indian Penal Code.
