As per the earlier direction, the Applicant and Respondent No.1 are present before the Court.

states that the charge sheet has not yet been filed in C.R. No.181 of 2010, prayer of cancellation of which is made by the Applicant.

Respondent No.1 – original complainant had filed an affidavit dated 2^nd May, 2012 stating that he has resolved all the disputes between him and the present Applicant – Accusedand the Respondent No.1 has no objection if the

C.R.No.181 of 2010 registered by the Police at his instance be quashed. The said affidavit is marked “X” for identification.

The wife of Respondent No.1 is also present in the Court and filed an affidavit of today’s date mentioning that all the disputes between the Applicant and Respondent No.1 so also the inter se between Respondent No.1 and herself are settled. The said affidavit is marked “X-1” for identification.

In view of the above mentioned factual position as mentioned in the affidavit of Respondent No.1, the present matter can be put to an end allowing the concerned parties to amicably put an end to this matter. Accordingly, the present application is allowed and C.R.No.181 of 2010 pending with the Kherwadi Police Station, Mumbai is hereby quashed and set aside.

Accordingly present Petition is disposed of.
