What is challenged in this appeal is the order dated 2 February 2012 of the learned trial Judge of this Court granting liberty to the defendant No.4 to deposit the original share certificates, which are the subject matter of Suit no.72 of 2011, in the Court.

Since the learned single Judge has already clarified that by merely depositing the share certificates in the Court, no rights are created either for or against any of the parties including defendant No.4, we do not see any justification to entertain this appeal, more particularly when notice of motion No.59 of 2011, in which the above impugned order was passed, is very much pending before the learned trial Judge and is already partly heard.

Appeal stands disposed of accordingly. All contentions of the parties are kept open.
