. Heard the learned counsel for the parties.

2 The learned counsel for the parties submit that, the application at Exhibit – 5 was fixed for hearing on 30th June, 2012. However, the Respondents herein have not filed written statement yet in the said application at Exhibit – 5. The learned counsel for the Respondents on instructions from his client submits that, the Respondents will file written statement before the concerned Court on or before 5th July, 2012 after serving

a copy on the Appellants herein i.e. original Plaintiffs. It is reported by the learned counsel for the parties that, the next date of hearing of the application at Exhibit – 5 is 7th July, 2012.

3 The Civil Judge (Senior Division), Ahmednagar before whom the application at Exhibit – 5 in Special Civil Suit No.72 of 2012 is pending, is directed to hear the parties in the application at Exhibit – 5 on 7th July, 2012 itself and if felt necessary on 9th July, 2012, and render the final decision on the said application at Exhibit – 5 on or before 9th July, 2012. Since the Exhibit – 5 is the application for temporary injunction, the concerned Court is directed to hear and decide the said application on the scheduled date i.e. on 7th July, 2012 and after hearing, pass the appropriate order on or before 9th July, 2012. It is made clear that, the concerned Court shall not grant adjournment to the parties and decide the said application at Exhibit – 5, at one way or other.

4 Till the disposal of said application, interim order dated 11th June, 2012 passed by this Court to continue.

5 On the above terms, the appeal from order and the civil application stand disposed of.

6 Till the application at Exhibit – 5 is disposed of by the Civil Court, the Respondents would be at liberty to make arrangements to keep the cement bags and other construction material lying on the suit property under shed.

7 The parties are directed to act upon the authenticated copy of this order.
