Noorun Nisha Mohammed Rais as vendor at serial no.7. Her name was however scored off possibly because she backed out. Thereafter, another sale deed was executed in favour of the applicant on 17th March, 2009. Those executing the sale deed include Noorun Nisha Mohammed Rais as also Bakshulla. The consideration seems to have been paid by bearer cheques to the executants of the second sale deed. The persons who executed the document had been identified by one Abdul Kalam Ikbal Husain and Majid Ikhak Shaikh who have been arrested by the police and who state that they identified the executants at the instance of the applicant. The learned counsel for the applicant states that in fact it was the applicant's complaint that he had been duped by setting up some bogus persons to execute the sale deed and that he had filed such a complaint with the police which led to registration of an office on 12th April, 2012. He submits that the offence in which he apprehends arrest has been registered on 7th May, 2012. It appears that the complainant has already filed an complaint with the police Inspector at Panvel on 23rd May, 2011 though the offence seems to have been registered late. Thus, it is not the applicant first rushed to the police and thereafter the first informant filed a report to save themselves from the allegation about cheating.
