Heard Mr. Mendadkar the learned counsel for the petitioners, who are the full brothers. Mr. Sonawane, the learned AGP appears for the respondents.

The petitioners claim belong to caste “Koli Mahadev”, which is a Scheduled Tribe recognized in the State of Maharashtra. While the

petitioners were studying at S.S. & L.S. Patkar College of Arts & Science and V.P. Varde College of Commerce & Economics at Mumbai, the Principal of the said College had forwarded their caste claim for scrutiny to the respondent no.2-Committee vide his letter dated 30/11/2009 and 30/10/2010 respectively. As per the petitioners, the respondent no.2 – Committee has not yet completed the verification proceedings and, therefore, they have not yet received the caste validity certificate.

In the meanwhile, petitioner no.1 has been granted admission to the first year of BE (Computer Engineering) with the respondent no.4College run by the Government of Maharashtra in the current academic year i.e. 2011-2012 and against a seat reserved for Scheduled Tribe. As per the conditions of admission, the petitioner no.1 is required to submit his caste validity certificate on or before 30/11/2011 and solely because the proceedings are still pending with respondent no.2 – Committee, he would not be able to submit a validity certificate to the Principal of respondent no. 4 – College. Hence, this petition for directions.

We direct the respondent no.2 – Committee to complete the caste scrutiny proceedings presently pending before it and in respect of the petitioners as expeditiously as possible and in any case before 31/3/2012. Consequently, the last date for submission of the caste validity certificate to respondent no.4 – College is extended from 30/11/2011 to 31/3/2012.

Petition is disposed off in terms of the above directions.
