Samasu Dadhabhai Momin Vs the State of Maharashtra Home Depat. and Ors.

On behalf of the Petitioner it has been stated that the auto rickshaw was fitted with a CNG kit and there was no intention to breach the prohibitory order passed by this Court. The learned Additional Government Pleader has taken instructions and has stated that there is no objection to the auto rickshaw being released. In the circumstances, the Petition is disposed of by directing the Second Respondent to release the auto rickshaw of the Petitioner bearing registration No.MH-43-C-4647 conditional on the Petitioner taking it out of the city of Greater Mumbai. The Petitioner shall also furnish an undertaking prior to the release of the vehicle that the auto rickshaw will not be plied within the limits of the city of Greater Mumbai and that the Petitioner would get the CNG kit duly endorsed from the concerned RTO. The Petition is accordingly disposed of.
