1] Heard learned counsel for the parties.

2] Learned counsel for the petitioners does not press this writ petition and seeks liberty to the petitioners to make representation for seeking rental compensation alongwith interest. The petition is disposed of as not pressed with liberty as prayed.

3] If the petitioners make representation, as aforementioned, within a period of four weeks from today, same may be considered and decided by the concerned Special Land Acquisition Officer, as expeditiously as possible and preferably within a period of six months from the date of the representation. It is open to the petitioners to rely upon the judgment of this Court dated 24.7.2008 in Dinkar Sandipan Gholve and others Vs. The State of Maharashtra and others in Writ Petition No.2559 of 2008 or any other such judgment of this Court or of the Supreme Court in support of their claim. We hope and trust that the Special Land Acquisition Officer shall deal with the representation made by the petitioners in the light of the judgments that will be cited before him. We observe that the Special Land Acquisition

Officer while deciding the representation of the petitioners, will issue notice to the acquiring body and grant them an opportunity of being heard. It is needless to mention that if the representation of the petitioners is allowed, the payment to the petitioners may be made expeditiously.

4] The petitioner/s is/are directed to pay the deficit court fee within a period of two weeks from today. The office is directed to issue authenticated and/or certified copy of the order only on such deposit of deficit court fee being made by the petitioner/s.

5] With these observations, Writ Petition is disposed of.
