None appears for the petitioner when the matter is called out. Even after
waiting for some time since no appearance is made, there is no option before us
but to dismiss the petition for non-prosecution. At the same time, we make it
clear that case is made out by the private respondent in reply affidavit, all
questions raised therein are left open to be decided at the appropriate stage as
and when occasion arises.
In view of dismissal of the writ petition, nothing survives in the
application. Same is also dismissed.
