Heard the Learned Advocates appearing for the parties and the following order is passed by consent of the parties :-

(i) Respondent No. 2 who is present in Court states that he is supporting the Slum Rehabilitation Scheme on the subject plot and shall not oppose the same. The statement is accepted as an undertaking given to the Court.

(ii) Mr. Utangale, Learned Advocate appearing for SRA states that as and when the letter of intent is issued to the Developer for implementing the Slum Rehabilitation Scheme, the SRA shall provide a clause therein requiring the Developer to keep one commercial and one residential rehab tenement vacant which shall be allotted by the SRA to the party in whose favour the first Appeals being Nos. 47 of 2005 and 1220 of 1997 pending before this Court are decided.

(iii) The issue as to whether the Chief Executive Officer, SRA

has the power to review its own order is not decided in the present Writ Petition and is kept open to decide in an appropriate matter.

(iv) This order shall in no way prejudice the rights and contentions of the parties in the pending first Appeals being nos. 47 of 2005 and 1220 of 1997.

(v) The Writ Petition is accordingly disposed of.
