serial nos. 1 to 10 NCs came to be recorded on the complaint filed by the petitioner or on her behalf. The remaining two complaints i.e. the first one dated 1.10.2010 and the second one dated 10.1.2011. A copy of the complaint dated 1.10.2010 is not on record, but, the copy of the complaint dated 10.1.2011 has been annexed to the Petition as Exhibit-F. The petitioner is the mother of respondent no.2 who is marred. Admittedly the Gift Deed was signed on 15.8.2008 by the petitioner by which the subject flat i.e. Flat no.3, Bansari C.H.S. Ltd., Plot no.28, Pali Naka, 30th Road, Bandra(West), Mumbai came to be gifted to respondent no.2. However, subsequently the petitioner claimed that the Gift Deed was signed fraudulently and on mis-representation and the said Gift Deed is subject matter of challenge in the civil suits. The petitioner has filed a suit bearing no.1473 of 2010, and the petitioner’s son has filed a suit bearing no.166 of 2011 challenging the said will. From the record it is seen that Criminal Writ Petition no.2747 of 2010 came to be filed by the son alleging that the petitioner mother was in unlawful custody of respondent no.2. The said Petition was disposed off without expressing any opinion by this court on 11.10.2010 as the petitioner mother was produced before the court and none other than the son produced her, and the petitioner made a statement
