2.There is no dispute that the Government
granted extension twice after expiry of the
termofelectedmanagingcommittee.
Initially, the extension was granted on 7th
October, 2010 for a period of six months and
then vide order dated 18th March, 2011 for
further period of six months. Admittedly the
six months' extended period will get over on
4th October, 2011. The extension was granted
by exercising the powers under section 14
(3A) of the Maharashtra Agriculture Produce
Marketing Committee (Regulation) Act, 1963.

3.Learned counsel for the parties fairly
stated that we need not record reasons for
the order that we propose to pass and they
have agreed for the following order.

(a)Respondent No.4 shall submit provisional

voters list to Respondent No.3 - District
Deputy Registrar, Cooperative Societies,
Parbhani within a period of three weeks from
today. They shall also make the funds
available within a period of two weeks from
the date of such demand being made by
Respondent No.3 for conducting the election.

(b)Respondent No.3 shall take further steps

to conduct the election of Respondent No.4
Market Committee and complete the election
process on or before 4th of October, 2011.
Learned counsel for Respondent No.4 submits
that they shall cooperate for conducting the
elections within the stipulated time. The
statement is accepted.

(c)If, for any reason, the elections are
likely to be delayed for more than one month,
the District Deputy Registrar shall appoint
an administrator as contemplated by section

the process of election within the stipulated
time by exercising all the powers conferred
on him under the Act and the Rules.
