The order of the Industrial Court which was challenged before the learned Single Judge was an ex-parte order. The Appellants had not appeared before the Industrial Court and all that is done by the Industrial Court by that order is that the Respondent workman is given benefit of the settlement entered into by the Appellant with the Union. There were considerable latches in filing the Petition. The learned Single Judge, therefore, dismissed the Petition. We see no reason to interfere with the order either of the Industrial Court or of the learned Single Judge, Appeal rejected.
