Civil Application No. 147 of 2011:

This is an application made by respondent no. 3 for withdrawal of the amount of Rs. 1,33,333/-.

In paragraphs 2 and 3 of the application reasons have been furnished for the urgent need for withdrawal.

Learned counsel for the respondent no.3 submits that respondent no.3 is ready to furnish solvent security to the satisfaction of the

Registrar (Judicial) of this Court and the appellant-Company can be

allowed to verify and scrutinize the nature of solvent security.

¶17

In view of the above, I am inclined to allow this application in

terms of its prayer. Hence the following order:

Civil Application is allowed. Respondent no.3 is allowed to withdraw an amount of Rs. 1,33,333/- (Rupees One Lac Thirty Three Thousand Three Hundred Thirty Three only) upon furnishing solvent security to the satisfaction of the Registrar (Judicial) of this Court.

It is made clear that the appellant shall be entitled to verify and scrutinize the solvent security that will be furnished. Registrar (Judicial) shall hear the objection, if any raised on behalf of the appellant.

The respondent no.3 shall in addition furnish usual

undertaking.
