Heard learned respective Counsel for the parties, finally.

This is an application preferred by the applicants requesting for extension of time for deposit of Rs. 2,00,000/-, as directed by this Court vide order dated 6th April 2011.

It appears that the applicants were granted pre-arrest bail by this Court in Criminal Application No. 3291/2010, by order dated 6th April 2011, and interim protection granted to them by order dated 30th August 2011 was made absolute, and while granting the said order, in pursuance of the undertaking,

the applicants were directed to deposit Rs. 2,00,000/- in the loan account of the Society within a period of three months from the said date, without prejudice to rights of both the parties, and this Court also observed, that the failure to entail in cancellation of discretion.

However, the applicants have submitted that due to their difficulties, the applicants could not deposit the said amount of Rs. 2,00,000/- in the loan account of the Society within the stipulated period, and hence, requested for extension of time to deposit the said amount.

For the reasons stated in the present application, it appears that the applicants were prevented to deposit the amount of Rs. 2,00,000/-, as directed by this Court, within the stipulated period, by order dated 6th April 2011, and interest of justice requires that a last opportunity be given to the applicants to deposit the said amount, as directed by this Court vide order dated 6th April 2011.

It is made clear that if the applicants fail to deposit the amount of Rs. 2,00,000/-, as directed by this Court, as aforesaid, till 30th August 2011, pre-arrest bail granted to the applicants by order dated 6th April 2011, shall stand cancelled automatically, and present Criminal Application stands disposed of finally.
