This is an application preferred by the applicant seeking anticipatory bail apprehending his arrest in connection with Crime No. 148/2011, registered at Kadim Jalna Police Station, Jalna, for the offences punishable under Sections 452, 325, 323, 504, read with Section 34 of Indian Penal Code.

It appears that the offence has been registered on the basis of the complaint lodged by the complainant, namely, Sindhu Anantrao Joshi, on 4-7-2011, in respect of the occurrence of the alleged incident on 12-5-2011. Apparently, allegations are in respect of altercation which allegedly took place on 12-5-2011 wherein role assigned to the present applicant is that he caught hold of complainant Sindhubai, and co-accused Swapnil Shingare assaulted her by means of stick on her legs. It is submitted that the co-accused Swapnil Shingare had been enlarged on bail by the learned Trial Court on 22nd July 2011, and wooden stick also has been recovered.

Besides, apparently, there is delay of about two months in lodging the FIR, since the incident occurred on 12-5-2011, whereas FIR was lodged on 4-7-2011. Moreover, this court granted ad interim relief in favour of the applicant on 22nd

July 2011, and same is effective till today, and hence, present application deserves to be allowed.

In the result, present Criminal Application is allowed, and the interim anticipatory bail granted in favour of the applicant stands confirmed with directions that (i) the applicant shall attend the concerned Police Station on every Tuesday and Thursday, between 05.00 p.m. to 07.00 p.m., till completion of investigation and cooperate in the investigation, and (ii) the applicant shall not influence upon prosecution witnesses and/or tamper with the prosecution evidence, in any manner, whatsoever, directly or indirectly, and the present Criminal Application stands disposed of finally.
