the pendency of the appeal. Reportedly, present applicant woman, convicted accused, is suffering from HIV and is presently lodged in Yerwada Central Prison. Earlier vide order dated 18th April, 2011 directions were given to Yerwada Central Prison to file report regarding present health condition of the applicant-accused and availability of the treatment in prison in relation to her sickness.

Said report also mentions that the Prison Hospital is sending the patient to Sassoon General Hospital as per requirement time to time and treatment is given under the supervision of medical officer in jail. Along with the report a proforma is produced by the Superintendent, Central Prison, Yerwada giving the details of the present petitioner/prisoner which mentions that actual period undergone up to February, 2011 is three years, two months and twenty seven days. Whereas set off period is five years, six months and 29 days.
