On the earlier date it was reported to this Court on behalf of the Appellants that both the Appellants were reportedly encountered by Police. Today, report is filed by Senior P.I., Dongri Police Station, Mumbai mentioning that Appellant No.1 Sajid Ali Hasan Ali Zaveri has been encountered by Police in 1997 and the offence punishable under Section 387 r/w. 34 of I.P.C. had been registered and vide order dated 8th October 1998 orders of abated summary were passed by the Additional Chief Metropolitan Magistrate, 2nd Court, Mazgaon, Mumbai. So far as Appellant No.2 Abid Ali Hasan Ali Zaveri is concerned, it is reported that he died on 31st July 1999 and A.D.R. No. 67 of 1999 has been registered with Dongri Police Station. In view of said report, present Appeal abates and accordingly disposed of.
