Allowing Application of PW-1 Arun Poojari tendered by way of examination in chief is questioned by the original Accused. I do not see any error on the part of learned Judge to entertain the affidavit and also the additional document as the document primarily is not a new creation it is on account of long drawn correspondence between the parties. The objection raised by the Applicant herein is unsustainable. The Petition lacks merit. Dismissed.
