This is an application by the

applicant/complainant who was injured and for
causing injury to whom the appellants have been
convicted by the learned Addl. Sessions Judge,
Satara. The learned Judge held the appellants

guilty of the offences punishable under
Sections 147 and 323 r/w Section 149 of the
IPC. The complainant, who is present in the
Court with his counsel, states that the parties
have amicably settled the disputes and the
crime may be compounded and the appeal may be
disposed of in terms of the settlement. In view
of this, the application is allowed. The
offence punishable under Section 323 r/w
Section 149 of the IPC is allowed to be
compounded. Since the offence punishable under
Section 147 of the IPC was only preparatory to
the offence punishable under Section 323 r/w
Section 149 of the IPC, that is, forming an
unlawful assembly and committing rioting, in
view of the settlement of disputes between the
parties, the appeal, in so far as it relates to
the offence punishable under Section 147 is
concerned, is allowed. The judgment and order
of the trial Court is set aside. All the
appellants are acquitted of the said offence.
The appeal is disposed of in above terms. Fine,
if any paid, be refunded. Bail bonds stand
discharged. The application and the appeal
accordingly stand disposed of.
