Having regard to the limited nature of the grievance of the

petitioner and the order that we propose to pass in these proceedings, it is not necessary for this court to direct issuance of a

court notice. The learned AGP has appeared for respondents no.1

¶19

and 2, while, the third respondent is represented by counsel. The learned counsel appearing on behalf of the petitioners, states that private service has been effected on respondents no.3, 9, 12, 14, 15 and 16. The only grievance of the petitioners is that, on 26^th April, 2010 the District Judge at Thane had granted a stay to certain directions of the Joint Charity Commissioner till 30^th April, 2010. On 30^th April, 2010 time to file reply was granted to the respondents and the interim stay was extended till the respondents file their replies. According to the petitioners, the stay continued to hold the field until 17^th June, 2010. Thereafter, the application for grant of stay has not been taken up by the District Judge at Thane since he was pre-occupied by other judicial work. However, according to the petitioners as a result of this, fresh elections have been called for by the Assistant Charity Commissioner since the order of stay has not been extended.

In our view, it would be appropriate and proper to request

the learned District Judge to take up the stay application in Civil Miscellaneous Appeal No.91 of 2010 preferred by the petitioners on

board and to decide it expeditiously and preferably within a period of 2 weeks from today. The petition is accordingly disposed off.

There shall be no orders as to costs.
