1] In response to the orders passed by this court, Dr. Nirupama Dange, who is holding the office of the respondent No.2 and Mr. R.W. Mahajan, who is holding the office of the respondent No.2, are personally present in the court.

2] The court was required to summon the personal presence of these two officers since it was noticed that though on earlier occasions, notices were issued twice i.e. 8^th May, 2010 and 16^th August, 2010, the respondents had failed to put in their appearances.

3] When notice is issued by this court, the State and its instrumentalities are duty bound to respond to the notice of this court, so as to effectively assist the court in the administration of justice.

4] Shri Sonawane, learned counsel appearing on behalf of the respondents states that non-appearance of the respondents was not intentional but since the concerned clerk did not intimate the respondents about the orders passed by this court, they could not respond to the notice.

5] Shri Sonawane, on instructions, makes a statement that the order passed by the Grievance Committee would be complied with, and necessary appointment orders will be issued in favour of the petitioner within a period of 4 weeks from today.

6] Accepting the explanation given on behalf of respondent Nos. 1 and 2, that the non appearance on their part was not intentional, we discharge the notices issued to them.

¶19

7] Accepting the statement made on behalf of the respondent Nos. 1 and 2 that the order of the Grievance Committee dated 2^nd July, 2009 would be implemented within a period of four weeks from today, the writ petition stands disposed of.
