have perused the reply affidavit dated 8.1.2010 filed by the Superintendent of Kolhapur Central Prison and more particularly para7 thereof. It appears that after the impugned order, the petitioner was granted furlough leave for a period of 14 days and he accordingly enjoyed the furlough leave and the said furlough leave was also extended for a further period of 14 days and he surrendered on 25.12.2009. In the circumstances, the petition has become infructuous and disposed of as such.
