have perused the reply affidavit dated 8.1.2010 filed by the Superintendent of Kolhapur Central Prison and more particularly para-7 thereof. It appears that after the impugned order, the petitioner was granted furlough leave for a period of 14 days and he accordingly enjoyed the furlough leave and the said furlough leave was also extended for a further period of 14 days and he surrendered on 25.12.2009. In the circumstances, the petition has become infructuous and disposed of as such.
