This Writ Petition has been admitted after hearing the parties only to consider prayer clause (e) vide order dated 25^th November 2009. Prayer Clause (e) reads thus:

“e. That this Hon’ble Courtbe pleased to issue appropriate writ, order or direction to the Respondents to issue the licence to the Petitioner Trust and allow the Petitioner to commence the indoor games activities at premises situated at 108/B, Pratap Ganj Peth, District Satara bearing CTS No.283/2A & 2G, plot No.4, Office No.13, 14, 15, 18 & 19, 1^st floor of Panchshil Park Bldg. As per challan No.3/09 dated 25.05.2009.”

During the pendency of the Writ Petition, Petitioner has taken out

Criminal Application which in substance prays for the same relief which is

the main relief sought in the Writ Petition. The limited grievance of the Petitioner is that although the Petitioner has made several applications from time to time and the last in point dated 15^th January 2008 Exhibit `C’ at page 52 of the paper-book, no decision has been taken by the Collector of District Satara so far, for the reasons best known to him.

In the circumstances, the Petition can be conveniently disposed of by directing the Collector to consider the pending application of the Petitioner dated 15^th January 2008 on its own merits in accordance with law.

We are not expressing any opinion on the merits of the grounds agitated in the present Writ Petition or for that matter, the Application preferred by the Petitioner before the said Authority. We further direct the Collector, District Satara to take final decision on the said application as expeditiously as possible and in any case, not later than eight weeks from today.

Petition as well as Criminal Application disposed of on the above terms.
