By way of this petition, the petitioner has prayed that the petitioner

may be given benefit of Fifth Pay Commission and benefit of promotion at an appropriate time in an available vacancy as per the Service Rules. Mr. Nalawade, learned Government Pleader, states that respondent No.3 may send a proposal in this behalf to the State Government and after receiving the same, the State will consider the same and take appropriate decision in accordance with the Rules. Mr. Kumbhakoni, learned counsel appearing for respondent Nos. 2 and 3, submits that a fresh proposal in connection with the subject matter of this petition will be forwarded to the State Government within a period of four weeks from today. On receiving the same, the State may take

an appropriate decision within a period of eight weeks thereof in accordance with law and pass an appropriate order in this behalf and whatever may be the decision, the same may be communicated to the petitioner. However, before taking any decision, the State may afford reasonable opportunity of hearing to the petitioner so that the petitioner may point out his grievance in detail. If the petitioner has still any grievance, it will be open to him to challenge the same.
