The petitioner has approached this Court in public interest litigation making a grievance in respect of misappropriation of municipal taxes (house) collected by officers of the Municipal Council of Ambernath, District Thane. It is the case of the petitioners that this criminal misappropriation and fraud committed by staff of respondent Ambernath Municipal Council, Ambernath, Dist. Thane on being noticed by the petitioner, he filed a complaint in Ambernath Police Station but no action has been taken in the matter. It is, therefore, contended that this Court

should direct the authorities to prosecute the officers for criminal breach of trust, misappropriation and cheating.
