The management/respondents have

tendered a cheque of Rs. 5,00,000/- (Rupees Five Lac) being cheque no. 619142 from account no. 494 duly signed by President and Secretary dated 11^th August 2010 favouring the Registrar of this Court. The petitioner herein shall withdraw the amount of Rs. 5,00,000/- from this Court by furnishing surety to the satisfaction of learned Registrar of this Court. This payment will be subject to out come of Writ Petition No. 3528 of 2007.

In addition, it is agreed between the parties that the petitioner Shivshankar Rathod shall report B. B. Arts and N. B. Commerce and B. P. Science College Digras district Yavatmal as a Junior College Teacher on 16^th August 2010 at morning session. The Management accepts to maintain muster for attendance of the petitioner-teacher, till the decision in the Writ Petition No. 3528 of 2007. The petitioner shall be entitled to receive regular salary till disposal of Writ Petition No. 3528 of 2007 on his resuming duties as indicated above.

The pursis to this effect duly signed by the respective parties and the counsel is tendered. In the light of above arrangement arrived at between the parties Contempt Petition no. 96 of 2010 is disposed of.
