In reply signed by Education Officer – Ram Kisan Pawar, dated 25th January, 2002, and in particular paragraph 6 thereof, it is indicated that the petitioner and respondent no. 3 are working as Head Master and both are getting salaries in the scale of Head Master. There is no dispute as such remain and the order of School Tribunal dated 27.4.2001 is now become inoperative.
The statement being made is not controverted by the petitioner herein and the petitioner

by efflux of superannuation has retired.
The writ petition lacks merit. Dismissed. No
costs.
