By consent of the parties, the following order is passed:

i. The respondent Company shall deposit an amount of Rs.2,00,000/(Rupees two lacs only ) with the Prothonotary and Senior Master of this Court within a period of four weeks from today.

ii. Upon deposit of the said amount, the Advocate for the Respondent Company shall forthwith inform the petitioner as well as their Advocate that the said amount has been deposited with the Prothonotary and Senior Master of this Court.

iii. Within three weeks from the receipt of the information regarding deposit of the said amount of Rs. 2 lacs from the Respondent Company by the Advocate for the Petitioner, the Petitioner shall file a Suit before

this Court pertaining to the subject matter of this Petition and seek appropriate reliefs. The petitioner shall also forthwith forward a complete copy of the plaint in the Suit to the Respondent Company.

iv. In the event of the Petitioner’s failure to file a Suit within three weeks from the date of his Advocate’s receiving information qua the deposit of Rs. Two lacs, the Respondent shall after giving notice to the Advocate for the Petitioner be entitled to receive back the said amount of Rs.2 lacs.

v. The Petitioner shall be at liberty to apply for ad-interim/interim reliefs in the Suit.

vi. The Prothonotary & Senior Master shall invest the said amount of Rs. two lacs with a Nationalised Bank initially for a period of one year and thereafter for three years at a time subject to ad interim/interim orders passed by this Court in the Suit filed by the Petitioners.

vii. All contentions of the parties are kept open.

viii. The Company Petition is accordingly disposed of with no order as to costs.
