2 This is an application for stay. Learned advocate has drawn by attention to paragraph no. 5 of the claim petition in which it is stated that the present appellant who was original respondent no. 3 had also sold the motorcycle to respondent no. 4 Shamrao Pawar. So as per the claim petition, original respondent no. 4 Shamrao Pawar was the owner of the

vehicle. Learned advocate also drew my attention to xerox copy of the saledeed produced on record. By said sale-
deed, the motorcycle was sold by the appellant to original respondent no. 4 Shamrao Pawar. Moreover, the bond executed by original respondent no. 4 Shamrao Pawar in favour of police, while getting back the custody of motorcycle after accident, is also produced. Said bond clearly discloses that it was original respondent no. 4 Shamrao Pawar who was owner of the vehicle when the accident took place. In view of the abovesaid circumstances, interim relief granted in terms of prayer clause ‘B’. Application is accordingly allowed and disposed of.
