1This is an application made by the original

accused No.1 for grant of bail. Applicant has been
shown as an accused in C.R.No.46/2008 registered by

Shirala Police Station for alleged offences under
Sections-302 and 120B of the I.P.C. The persons
who have killed the deceased are admittedly accused

Nos.12,13 and 15. In so far as present applicant is

concerned, the allegation against him is that he
along with Accused No.4 had visited the farm of
the deceased father and had quarreled with the

father. It is alleged that thereafter, he has
called accused No.2 who is his nephew and some
talks took place between them and thereafter,
accused Nos. 2,3 and 5 alleged to have carried out
the execution of the deceased. The nature of the
discussion which took place between the applicant
and the accused Nos.2,3 and 5 is admittedly not
known. Accused No.4 Adhik Pandurang Patil has
already been released on bail. In the

circumstances, I am inclined to grant bail to the
applicant subject to certain stringent conditions.
It is therefore, directed that pending his trial in
pursuance of C.R.No.46/2008 registered by Shirala
Police Station, the applicant may be released on
bail in the sum of Rs.15,000/- with one surety in
the like amount subject to the condition that
applicant will reside outside Shirala Taluka till
the trial is completed. The applicant will before
his release furnish to the Jail authorities the
address where he propose to reside and he will
report to the Police Station Officer of the Police

Station where he intends to reside once in a week
on every Monday. He will also not change the said
address without prior intimation of the Police
Officer. Application is disposed off.
