applicant/State, for condonation of
delay of five days caused in filing the
accompany criminal application, seeking
leave to file appeal against judgment
and order of acquittal dated 18.2.2010.

4) For the reasons stated in the present
application, it appears that the
applicant has explained the delay
satisfactorily. It also appears that
the said delay is not willful,
deliberate and intentional and certainly
it is not inordinate and, therefore,

same deserves to be condoned in the
interest of justice.

5) In the result, present application
allowed in terms of prayer clause (B)
thereof and delay of five days caused in
filingtheaccompanyingcriminal
application seeking leave to file
appeal, stands condoned and present
