By this application, applicant seeks pre-arrest bail in connection with C.R.No.555 of 2009 registered at Kalamboli Police Station, District Raigad.

The prosecution case in short is that there was some civil dispute between Amrut Pal Singh and uncle of the applicant regarding the sale of the property belonging to the latter. The complainant along with Amrut Pal Singh had therefore gone to the house of applicant’s uncle. At that time, the complainant was assaulted by the applicant and his

uncle with a rod. The complainant was admitted to a private hospital by Amrut Pal Singh and was subsequently discharged.

I have perused the medical report of the hospital, copy of which is annexed to the application. I have also perused the subsequent medical report, copy of which was handed over by the learned APP for inspection. The injuries mentioned in the medical report appear to be simple and there is no grievous hurt/injury. Taking this into consideration, the applicant can be granted pre-arrest bail. Hence, I pass the following order:-

In the event the applicant is arrested in connection with C.R.No. 555/09, he shall be released on bail on executing P.R. Bond of Rs. 15,000/- with one surety of the like amount subject to a condition that applicant shall not threaten the prosecution witnesses and co-operate with the investigation. Applicant shall also attend the concerned Police Station for interrogation on 1^st and 2^nd February 2010 between 11.a.m and 5.00 p.m for interrogation and on such other dates as may be specifically summoned.

This order shall remain in force for a period of two months where after he may if he so desires apply for bail before the regular court.
