In our opinion, the issue is squarely covered by the Judgment of this Court dated 22.1.2009 in V.R. Agarkar vs. The Chairman, Grievance Cell Committee, Pune University and others in W.P. No.4936 of 2006. That Judgment was thereafter followed in W.P. No. 2309 of 2007 decided on 30.4.2007. S.L.P. was preferred in respect of an order passed in W.P. No.2309 of 2007. The learned Supreme Court was pleased to dismiss the Special Leave Petition.

For the reasons set out therein, we pass the following order :-

In the light of that the respondent Nos. 1 and 2 based on the leave

record of the petitioner to calculate the leave of the petitioner to which he is entitled to and to pay him leave encashment for the maximum 180 days or lesser to the extent that the petitioner is entitled to. The entire exercise is to be completed within eight weeks from today. The respondent Nos. 1 and 2 to pay the amount in the first instance and if they are entitled to be reimbursed by way of grant from respondent No.3, then to apply to respondent No.3 for the same. Rule is made absolute in the above terms. There shall be no order as to costs.
