1Rule. By consent of the parties,

rule made returnable forthwith and the writ
petition is taken up for final disposal.

2By consent of the parties the orders

dated 6th December, 2007 and 20th February,

2009 are set aside only to the extent of the

back wages ordered to be paid to the

petitioner. The matter stands remanded to the
3rd Labour Court to decide afresh only the

issue of back wages payable to the petitioner
without disturbing the date of superannuation

i.e. 30th June, 2005 mentioned in the earlier

¶21

order. The parties will be at liberty to file
additional pleadings/documents, if any and
also to lead fresh evidence.

3The 3rd Labour Court is directed to

decide the said issue of back wages afresh on
or before 31st December, 2009. The parties
shall appear before the Labour Court on 10th
August, 2009 at 11.00 a.m.

4The writ petition is accordingly

disposed of.
