1.Heard the learned Counsel appearing on behalf of the
Plaintiff and the Defendants.

¶13

2.The Defendant No.3 has taken out this Notice of
Motion for appointment of the Court Receiver in respect
of flat No.42 on 4th Floor and also in respect of two car
parking spaces in Parking Bay in the new building know as
'Ashiana' which is under construction in place of Flat
No.52 which was situated in flat No.62 in the old
building.

3.The learned Counsel appearing on behalf of the
Defendant Nos.1 and 2 has no objection for appointment of
the Court Receiver in terms of prayer clause (a) of the
Notice of Motion.

4.In view of the no objection given by the Defendant
Nos.1 and 2, Notice of Motion is allowed in terms of
prayer clauses (a) and (b) and, accordingly, disposed of.
5.The Defendant Nos.1 and 2 shall enter into agency
agreement after he takes possesion of the said flat from
the Court Receiver.
