. In view of the fact that the departmental
enquiry is concluded, the appellant does not want to
prosecute this Appeal and seeks to withdraw the same.

2. It is further submitted by the learned counsel
for the parties that the writ petition has also become
infructuous in the matter. It will be proper that the
learned counsel for the parties move the learned Single
Judge in view of the subsequent development i.e.
conclusion of the departmental enquiry and seek
appropriate orders.
3. In so far as the appeal is concerned, we are
permitting the appellant to withdraw the same as
infructuous.
4. In view of the dismissal of the appeal, the
civil application does not survive. The same is
dismissed.
