The appeal is directed against the order passed by the learned Single Judge dated 3rd September, 2007. Vide the impugned order all that the learned Single Judge has done is to remand the matter to the Industrial Court for consideration of the preliminary issue in accordance with law in view of the Full Bench judgment of this court in the case of Gangadhar Balgopal Nair v. Voltas Limited and another, 2007(1) Bom. C.R. 1. In view of this, no reason for us to interfere. Dismissed.
