The claim of the Petitioner which forms the subject matter of these proceedings and the counter claim, if any, of the Respondent

shall be referred to the arbitration of Mr. Shyam Mehta, advocate practicing before this Court who shall act as the sole arbitrator under the provisions of the Arbitration and Conciliation Act, 1996. The costs of the arbitration shall be borne in equal proportion by both the sides and shall abide by the final award that may be passed by the learned arbitrator.
In view of the reference to arbitration in the aforesaid
terms, the Company Petition shall stand disposed of.
