Counsel appearing on behalf of the Fourth Respondent states on instructions that, the Revision Application, which has been filed before the State Government, is not being pressed and the Fourth Respondent has instructions to
pursue the Writ Petition (Writ Petition No.1902 of 2009), which has been filed in
this Court. The Fourth Respondent cannot, obviously, pursue two remedies, one
before the State Government in the Revision Application and the Writ Petition
proceedings before this Court, simultaneously. In view of the statement which has been made on behalf of the Fourth Respondent, Counsel appearing on behalf of the Petitioner has instructions not to press the Petition. The Second Revision Application No.330 of 2009 filed by the Fourth Respondent before State Government shall in the circumstances, stand dismissed as withdrawn and all interim orders, if any, passed therein shall stand vacated. The Writ Petition is accordingly stand disposed of.
