Heard learned counsel for the petitioner. None appears for the respondents, though served.

By this civil application, the applicant has prayed for restoration of the writ petition, which is dismissed by reason of non deposit of Rs.78,030/- as per the order dated 22.8.2007. Mr Udaipuri, learned counsel for the petitioner, submits that the petitioner is prepared to deposit the said amount with 12 percent interest from the date of the order, i.e. 22.8.2007, in the trial court

within two weeks from today. His statement is accepted. In view of the statement, the civil application is made absolute in terms of prayer clause (a). It is made clear that if the petitioner fails to deposit the amount, as aforestated, the writ petition shall stand dismissed for non prosecution without reference to the court.
