1.Mr.Dighe learned counsel for the applicant submits
that the applicant is not in a position to pay the court
fee stamps and submitted that the appeal may be restored
to file and some time may be given to pay to pay for the
court fee stamps. Heard learned counsel for the
applicant. First Appeal (St) No.15223 of 2008 is restored
to file and four weeks time is granted to the applicant
to remove all office objections including objection
regarding payment of court fee stamps. If the objections
are not removed within the said four weeks, appeal shall
stand dismissed finally for default. If office
objections are removed including the court fee stamps,
appeal shall stand restored to file.
Civil Application is disposed of.
