1This is an application for modification of
the order dated 18th December, 2008.
2It is submitted that this Court was pleased
to release the applicant on bail in the sum of Rs.
25,000/- with one or two sureties in the like
amount. It is submitted that the applicant is not in
a position to furnish the surety in the sum of Rs.
25,000/-. He, therefore, submitted that the said
amount may be reduced.
3In view of the ratio of the Apex Court
judgment in the case of Moti Ram & Ors. v/s. State
of M.P. (1979) 1 SCR Page 335, the amount of bail in
the sum of Rs.25,000/- is liable to be reduced since
the applicant has expressed his inability to furnish
the surety in the said amount.
4The applicant, therefore, be released on
bail in the sum of Rs.5,000/- with one or two
sureties in the like amount. It is clarified that
one surety shall be local surety. The applicant
shall report to the concerned police station twice
in a month.
5Application is disposed of.
