1.Heard the learned Counsel appearing on behalf of
the Applicants and the learned APP for the State.

2.The Learned APP for the State has filed affidavit
of the Assistant Commissioner of Police.

3.The Applicants apprehend arrest in connection
with C.R. No. 218 of 2009 registered at Bhadrakali
Police Station for the offence punishable under
sections 420, 465, 467, 468, 471-A, 120-B of the
Indian Penal Code.

4.It is alleged that one Ramrao Patil had obtained
loan in the name of various employees and had taken
their signatures on the pretext of giving them
permanent job in Nasik Municipal Corporation, and
thereafter, these signatures were used for the fake
and bogus loan proposal, which was taken from The
Sahakar Mitra Chandrakant Hari Badhe Sir Urban Co-op.
Credit Society Ltd. and which was used by him for his
personal use. It is alleged that the present
Applicants were working in the said credit society.
The only allegation against these Applicants is that
when the proposal was given to the Managing Director
of the society by one of the other accused and it was
seconded by some other accused, the Applicants have
allegedly signed the minutes of the said meeting in
which the resolution has allegedly been passed for
sanctioning the said loan. In the affidavit which is
filed by the Respondent, it is fairly stated that
their signatures were obtained subsequently and there
is no material on record to show that the Applicants
were present in the meeting when the said loan was
sanctioned.

5.In this view of the matter, the Applicants have
made out a prima facie case for grant of anticipatory
bail. Interim protection has already been granted by

order dated 16th October, 2009 by this Court. The
said interim order is confirmed.

6.The Applicants, in the event of their arrest in
connection with the C.R. No. 218 of 2009 registered at
Bhadrakali Police Station for the offence punishable
under sections 420, 465, 467, 468, 471-A, 120-B of the
Indian Penal Code, be released on bail in a sum of Rs.
10,000/- each with one or two sureties each in the
like amount. They shall co-operate with the police
and report to the concerned police station as and when
called.
