1. Heard rival submissions for some time.
It is the application for fixing early hearing
of Criminal Appeal. The said appeal is
preferred by the applicant, convicted accused,
against his conviction in Prevention of the
Corruption Act for the offence under Section 7
and 13(2) of the Prevention of Corruption Act.
The said conviction was passed on 31.8.2005 and
challenged before this Court in Criminal Appeal
on 27.10.2005.
2. Earlier by a separate order on the
application of the applicant, a prayer for
sunspension of conviction was rejected by this
Court. However, appeal was directed to be
expedited.
3. Presently, this Court is taking up the
matters of the years 1991 to 1995 in which
accused are on bail. The present
accused-applicant is also on bail and allegedly
suspended from the municipal service.
4. There is nothing to entertain the
present application in favour of the applicant
for early hearing of the matter. Hence, the
application is dismissed and accordingly
disposed of.
