This appeal is filed against the interlocutory order dated 18th September, 2009, passed by the learned single Judge in Chamber Summons No. 17 of 2008.

permission to the appellant to challenge the impugned order in appeal, if present appellant desires to file appeal against the decree passed by the learned single Judge. In our view, the objection of the learned counsel for the respondent is without any substance as any interlocutory order passed in the suit can always be challenged in an appeal filed against the decree in the suit. In such appeal, all available points can be taken in accordance with law.
