Considering the facts of the case, it will be for petitioner to make appropriate application before the Trial Court. Hence, the petition is not entertained and is disposed of with liberty to the petitioner to apply before the Trial Court. All the contentions raised in this petition are expressly kept open. If such application is made by the petitioner, the Trial Court will

decide the said application as expeditiously as possible.
