Learned counsel for the State submits that without prejudice to their rights and contentions this writ petition is not maintainable as the petitioner can very well make a representation to the Maharashtra Administrative Tribunal/competent authority who would consider the same. In the event of petitioner making such a representation, the Tribunal/competent authority shall consider all the aspects in accordance with law. In view of the statement made by respondents writ petition is disposed of. Respondents to abide by the statement.
